Why do I keep posting these?

Because the reason for the constitution and habeas corpus (which would be suspended during martial law) was so that the government didn't just go around detaining those who disagreed with it.

Because a government needs to adhere to laws, the most wholesome and necessary for the public good. Because taxes imposed need to have the consent of the people so as not to enslave them through debt. Because of the benefits of trial by jury, as during martial law there is no difference between judge, jury, and executioner.

Because freedom does not mean the ability to choose between a variety of breakfast cereals.


To quote from USConstitution.net martial law is defined as:

In strict dictionary terms, martial law is the suspension of civil authority and the imposition of military authority. When we say a region or country is "under martial law," we mean to say that the military is in control of the area, that it acts as the police, as the courts, as the legislature. Article 1, Section 9 states, "The privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it." Habeas corpus is a concept of law, in which a person may not be held by the government without a valid reason for being held. A writ of habeas corpus can be issued by a court upon a government agency (such as a police force or the military). Such a writ compels the agency to produce the individual to the court, and to convince the court that the person is being reasonably held. The suspension of habeas corpus allows an agency to hold a person without a charge. Suspension of habeas corpus is often equated with martial law.

Part of the reason for the Declaration of Independence was because of the standing armies that were among the Colonies during times of peace. Thus, in the Constitution one of the powers that congress was given was the power to raise and support armies. This was set in by Article 1, section 8: "Congress shall have the power...  "to raise and support Armies, but no Appropriation of Money to that Use shall be for a longer Term than two Years."

Additionally, Posse Comitatus or Power of Country, was passed into law June 16, 1878. This was done to prevent martial law - or "military police" in the country. Posse comitatus was overturned in 2006 by HR 5122 and then was restored recently by H.R. 4986:

This spits in the face of all of that and just puts standing armies on American soil.

If a bully threatens to beat up a skinny kid if he doesn't give him his lunch money, and the bully doesn't have to follow through because the kid does fork it over, does that mean that the aggressive kid isn't a bully?

There is no difference between martial law and the threat of martial law.
